Legislative Comments on the Principle of Dividing Responsibilities,Coordinating Efforts and Checking Each Other

YU Wei-qing(Political and Law Department,Fuyang Normal College,Anhui Fuyang,236032)
The principle of dividing responsibilities, coordinating efforts and checking each other is the basic principle of The Criminal Procedure Law of China. However, its provisions are redundant compared with other principles. It has aroused contradictions and confusions when public security organs and judicial organs perform the function of procedure. Moreover,it has caused some phenomena of backwardness in the criminal procedure judicial practices. So,it may be concluded that the principle of dividing responsibilities, coordinating efforts and checking each other is misconceived by the claim of China's actual conditions' requirements. It should be abolished when The Criminal Procedure Law of China is re-amended.
