An Analysis on Effective Breach with the Law and economics

Traditional view of the Contract Law is fairness,honesty and trustworthiness as its basic concept.After the appearance of the Law and Economics,people begin to reanalyze the breach system by using the economical methods and then get the conclusion that the default of non-breaching party is efficient when the compliance costs are too high.In this paper,with the methods of economics,the author briefly analyzes the above view to demonstrate the effective breach system is reasonable so as to help our gorernment change the concept of Contract Law and to really use contracts to promote economic development in our country.
