On the Establishment of the Analysis Paradigm of Law and Economics

Concretely speaking, for the analysis paradigm of law and economics the first problem is to apply marginal analysis method to resolve the optimization problems such as personal effect optimization, enterprise profit maximization and government tax maximization. The obtained optimal act congregation of related actors by marginal analysis method is equilibrium that is the core concept of the analysis paradigm of law and economics. The ultimate task of the analysis paradigm of law and economics is to carry on efficiency evaluation on the equilibrium composed of optimal acts of actors, namely to review whether some equilibrium is fit for efficiency standard. From this, it can be seen that the analysis paradigm of law and economics is a law studying frame that takes marginal analysis as tool, takes equilibrium as the main except and takes efficiency as the rule goal.
