On environmental tort executive compensation

SHEN Yue-dong(Law School,Fuzhou University,Fuzhou 350108,China)
Confined to the executive compensation system by the existing State Compensation Law,the academic society and practitioners of law do not distinguish between environment executive compensation and environmental tort executive compensation, while only concerned about the compensation for environmental administrative organs and their illegal use of authority and the damage caused. In reality, besides environmental executive authorities, other administrative organs and the state-owned public facilities may also cause damages through environmental vehicle to personal body, property and other legitimate rights and interests.Because the basis for causing such harm is a legal relationship between administrative law, there may be executive compensation, which should be noted in the process of amending of the on the State Compensation Law of People's Republic of China.
