Interpretation of the Protection of Traditional Knowledge and Culture Expressions Act in Kenya

Traditional knowledge and culture expressions have important cultural and spiritual values. Kenya pays much attention to the protection of traditional knowledge and culture expressions,and the protection of traditional knowledge and culture expressions act were promulgated by Kenya in 2016. This Act covers more items,such as protection criteria,maintenance of registers,right contents,duration of protection,exceptions and limitations,benefit sharing,management of rights,sanctions and remedies,etc. This law can be used for reference in many countries including China. At present,China is lack of special laws to protect traditional knowledge and expressions of folklore. By borrowing and improving the legislation of Kenya,China should enact special laws to protect traditional knowledge and expressions of folklore and to promote the development of traditional knowledge and expressions of folklore.
