On Compensation for Mental Damages Caused by Crime in China

With the development of politics, economy, culture, and people's increasing consciousness of rights, the ideas “Where there are damages, there is a compensation ”and“ Where there are rights, there is a relief” have rooted in people's hearts gradually. In the civil torts concerning the infringement of the natural person's rights, relevant laws and judicial explanation have affirmed that victims have the right to obtain compensation for mental damages. But in serious criminal infringement, there is a great controversy over whether criminals should be responsible for the compensation for mental damages. This paper analyses the necessity that criminals should be responsible for mental damages, the range of compensation, and the procedure of compensation.
