The Notice and Takedown System of the Copyright Law in the Age of Artificial Intelligence

The Notice and Takedown System of the current copyright law is the product of the web 1.0 era.It is presupposed by manual notice and manual review.With the development of web 2.0 and artificial intelligence technology,it has become normal to use algorithms to send out notices automatically and filter suspected infringing works automatically,which poses a great challenge to the traditional Notice and Takedown System.Notice and Takedown System,as a private regulatory mechanism,is originally the product of the compromise between content industry and technology industry,which lacks the consideration of public interests.Algorithmic enforcement further aggravates the imbalance of interests.In order to restore the balance of interests between the copyright owners,the internet service providers(ISP)and the public,the ISP should be required to undertake the duty of constructing a reasonable algorithmic design,disclosing the information of notice.It is also suggested that the exemption clause of black box test shall be introduced.
