On the Legal Issue of Excess Capacity in SCM Agreement

Excess capacity has not been domestic issue but has been international issue. In 13 th Jan. 2017,The United States has complained China ' s subsidies for supporting Chinese companies which produce aluminum( DS519) in WTO. It is the first time the United States complained China's excess capacity has been violated for SCM Agreement. The United States complains Chinese local governments give many sorts of subsidies to relevant industries according to industrial polies meanwhile these industries have serious excess capacity due to governments 'subsidies. We predict other countries would complain China's excess capacity again in the future,especially in Chinese coal or iron areas. This paper will examine to whether China's excess capacity has been violated for SCM Agreement under analysis three elements of subsidy thus it will find remedy measures for excess capacity.
