New Economics of Law:Theoretical Schools and Critical Review

The thesis discusses the historical background of the new economics of law and its several main schools, and makes some reflective comments on this subject. It points out that the new economics of law still lacks a definite object of study and an unified analytical frame, and has some problems in its viewpoint of value and methodology. So a wider theoretical vision is needed. Finally, this thesis points out that the new economics of law should study “cooperative order” as its studying object, extends its theoretical frame, and put forward some issues that need further consideration.
