Practional Operation on “Three-Needs” Theory in the Government Information Publicity Decree

The government information publicity system is important reflection of guaranteeing the citizens' right to know and also being part of it. At the same time, it is the fundamental obligation of modern government. However,the "three-needs" theory in Article 13 of Regulations on the Disclosure of Government Information brought about hot dispute and discussion in regard to the qualification of eligible applicants. According to the rules of "three-needs", the subject of application is restricted to the narrow range connected with citizens' production, life and scientific research needs, which goes against the protection of the citizens' right to know. By the means of theoretical analysis of the government information publicity system and comparative study of foreign legislative experience, the "three-needs" rules should not be the restriction of applicants. At most, it is just the requirement of giving reasons. Given that, development path of improving the qualification of application subject in our country 's the government information publicity is proposed at the end of this article.
