The Interests Balance Between Investors and Host States under the China-ASEAN Investment System

As One Belt One Road in action,China-ASEAN relations will be facing increasingly new opportunities and challenges. Among which includes arising risks and investment protection issues that are not merely legal issues but touch upon the public interests of ASEAN member states. It is indispensable to facilitate and safeguard the investments of "One Belt One Road"and to mitigate the investment disputes between the Party by enhancing the investment system that could balance the rights between investors and host States. Ever since 1985,ASEAN which is the main FDI areas among the developing countries for most Chinese investments,has signed traditional bilateral investment treaties and regional investment agreements,namely ASEAN-China Investment Agreement. Despite the ambiguities on some clauses,investment clauses have been incorporated with new elements and formats,and demonstrated the norms of "benevolence"in the balances between rights of host States and investment protection.
