The Jurisprudential Basis for Reconstructing the System of Penalty in China in the Age of Artificial Intelligence

In the era of artificial intelligence,intelligent robots may have the ability to identify and control their own behavior. Intelligent robots,who have committed serious harm to society outside the scope of the design and preparation procedures,should be penalized. The existing penalty system in China consists of life penalty,freedom punishment,property punishment and rights punishment. All kinds of penalties cannot be applied to intelligent robots. Reconstructing the system of penalty and embracing intelligent robots in the scope of penalties,meet penalty purposes and the needs of the development of the artificial intelligence era. In the same time,this article suggests to add penalties such as deleting data,modifying the program,permanent destruction,and so on. And additional penalties,such as the property penalty or the right penalty should be applied when the conditions become due. Bringing intelligent robots into the scope of penalties means intelligent robots are recognized as members of society in essence,which depends on the extent that the intelligent robots participate in human life and social status that the intelligent robots enjoy.
