On Methods of Apportioning Infringer'Profits in Calculating Intellectual Property Damages

The greatest difficulty in calculating infringer' profits is to determine the proportion or apportionment of infringer' profits caused by the infringement. Chinese courts mainly use qualitative analysis method to apportion infringer' profits,resulting in great uncertainty of apportionment. We should use the net income of economics as the standard to evaluate the advantages and disadvantages of the methods and the recommendations to improve the methods. The cost-benefit analysis method is adopted to determine the net income. When satisfying the applicable conditions,the rank of methods from superior to inferior is as follows: alternative comparison method,consumer survey method,quantitative proportion method and qualitative analysis method. It is suggested that China comprehensively adopt the above four methods of apportioning infringer' profits.
