Thinking on Examination of Sufficient Disclosure of Description

The sufficient disclosure is the minimum requirement for drafting a description. This paper interprets the relevant provisions of the Guidelines for Patent Examination and illustrates the relationship among clarity, completeness and enablement in Article 26.3. With practice cases analysis, consideration on clarity and completeness of a description in assessing whether a description is sufficiently disclosed is provided. Besides, examination logic between sufficient disclosure of a description and amendment going out of scope is illustrated with a specific case and thinking on examination of sufficient disclosure of description is provided.
