Judicial Logic of People's Courts Participating in Rural Governance in New Era:Based on Analysis of People's Court Z in Beijing

LI Ling-yun;Kenneth Wang School of Law,Soochow University;
The historical mission of rural revitalization in the new era requires the participation of the people's court.Taking People's Court Z in Beijing as a sample,it is found that the court has played an effective role in resolving contradictions and developing the society.It also encountered the relative imbalance between the case trial and the rural governance,and the inability to be equal to the rural interests.To this end,we should determine the judicial bond status of the people's court in the rural governance system,and make it clear that it can provide judicial guidance for the construction of public security prevention and control system,provide judicial team for the adjustment of social relations,and provide judicial information for the country's major decisionmaking.In the process of the participation of the people's court in rural governance,only the mode of judicial logic is a feasible way,that is,taking into account the judicial ideas of litigation concept and limited participation,judicial technology that focuses on the integration of legal norms and township rules and regulations,and the judicial path to co-ordinate external cooperative governance and internal reasonable adjustment,so as to realize the further integration of"case trial"and"rural revitalization".
