Judicial determination of gang-related crimes from the perspective of criminal policy: content,defects and responses

In view of the judicial determination of gang-related crimes,China not only advocates the implementation of the macro criminal policy of combining leniency with strictness,but also advocates the implementation of the specific criminal policy of "fight early and fight small". In the judicial practice,because of the lack of relevant norms and the lack of understanding of the relationship betw een criminal policy and criminal law by judicial staff,the organized crime of the underworld is judged without leniency and the suspects of gang-related crimes are repeatedly evaluated. In response to these problems,we should persist in responding through the two channels of normative and practical aspects under the guidance of relevant criminal policies,so as to achieve the coordination of legal protection and human rights protection and the unity of the rule of law effect and social effects in the judicial determination of gang-related crimes.
