The Principle of Separation of Prosecution and Trial in the Criminal Procedure Law of China: the Present Situation,Problems and Improvement Path

The Criminal Procedure Law of China,to much extent,reflects the principle of separation of prosecution and trial,but still has some deficiencies,such as immoderate cooperation between the procuratorate and the court and unreasonable functioning of investigation activities which hinder the implementation of such separation.These discrepancies hampers the neutral position of the court and diminish the justice value of criminal procedure,which should be improved in the process of the law revision.
