A Research on the Rights of Employer's Unilateral Change of Labor Contract
Due to the continuity and stability of labor contract, employers have realistic demand of changing labor contract because of the needs of production and operation during the existence of labor relationships. But current law stipulates that the change of labor contract change must be agreed by both parties which over emphasizes on the principle of consensus and lack flexibility. So that it greatly limits the autonomy of business operation. Therefore, some rights should be given to the employer by our labor law such as changing the labor contract. But, at the same time, in order to protect the legitimate rights of the employee, we must control the rights within the legal boundaries. The examination standard should be set to prevent the illegal changes of employer. And then the relationships between employer and employee could be balanced.
