47 Cases of Medical Disputes Resolved through Judicial Means

Objective To analyze the characteristics of medical disputes through judicial means. Methods Documents of medical disputes which settled through judicial means in a large comprehensive hospital in the past 6years were reviewed. Results All 47 cases was enrolled. Among them,30( 69. 8%) cases were related to surgery,18( 38. 3%) patients were dead,and 33( 70. 3%) cases were undergone court judgment at last. The number of dispute cases and average compensation increased significantly after the implementation of the tort liability law( 34 vs 13 cases,P 0. 05; 129 525 vs 63 781 RMB,P 0. 05). Conclusion While improving the medical treatment level,popularizing the related laws and regulations to medical staff is very important to reduce the medical disputes which are resolved by the judicial way.
