Analysis of the Resolution of Mass Disputes

Recently,there have been a lot of mass incidents which cannot be properly tackled by representive action which is limited by judicial interpretation.Class action and group action have enormous advantage of dealing with mass incidents,but in the context of China's judical incapability,mere legal transplants will not be workable.The reason of law not only lies in law,but also in the environment in which law operates.The build-up of legal system must be in connection with social reality.Therefore,Test Case,in the traditional litigious struction of plantiff VS respondent,shows tremendous advantage of dealing with mass disputes
