Research on Legal Coordination of China-ASEAN Geographical Indications under Background of the 21st Century“Marine Silk Road”

The 21 st century "Marine Silk Road" is the new strategy for opening up to the world proposed by Chinese government under the background of new international politics and trade. One of the aims of the construction of economic zone is to promote agricultural products trade circulations. China-Asean Free Trade Area is the important areas for construction of the 21 st century "Marine Silk Road" economic belt.Both China and ASEAN countries have rich and unique resources of agricultural and sideline products,most of which are under respective national geographical indication protection, giving birth to economic basis for establishment of bilateral legal coordination system of geographical indications. However, establishment of bilateral legal coordination system of geographical indications is confronted with numerous troubles due to the difference betweenc China and ASEAN countries in selection of geographical indication protection modes and different appeal to international protection of geographical indications. The two sides' agreement on cooperation of geographical indication protection should be the long-term objective for establishment of bilateral legal coordination system of geographical indications. The medium-term objective is to construct bilateral registration certification system of geographical indication. The present specific measure is that both sides encourage holders of respective national geography indications to register in the other involved country and mutually facilitate registration of geographical indications for each other.
