Modern Criticism of The Theory of Human Nature Of Pre-Qin Legalists

WEI Zhixun;WANG xiao;Law school of Shandong University;
The theory of human nature of Pre-Qin Legalists is not only the basis of Legalist theory construction,but also distinguishes legalist theory from other theories.Although representatives of Legalists are so many that their views are totally different from each other,they have the theory of human nature in common and it is reflected in the political theory and practice of Legalists.From the perspective of history,the political theory and practice derived from theory of human nature of Legalists objectively helps many kingdoms in that time make the nation rich and the army strong,consolidate the authority of monarch,strengthen centralization of authority and promote the unification of Qin in reality.However,the theory of Legalists essentially serves for autocratic monarchy,which means it is contrary to the spirit of the modern rule of law that power should be restricted effectively,so we must reinterpret the theory of human nature of Pre-Qin Legalists in a critical manner to achieve the goal of rule of law.
