上海市医疗机构聘用非卫生技术人员现状及监管对策探讨

In order to study the types and the causes of illegal behaviors of medical institutions and discuss the supervisory strategies for employing non-technical personnel, we analyzed the penalty cases on employing non-technical personnel by Shanghai medical institutions in past three years. Data on penalty cases indicated that both public medical institutions and private medical institutions engaged non-technical personnel, and the number of punished medical institutions is equivalent. We found two main types of illegal behaviors, one of which was the medical institutions engaged the medical school graduates who have no certification for professional physician to serve patients independently, the other one was the physicians serve patients in other uncertificated specialty, but the causes of two illegal behaviors were vivtually different. We make suggestions that enhancing legal education for medical institutions, physicians and medical school students to advance their medical legal consciousness; creating new supervisory means constantly and exploring the classified surveillant methods combining with education, service and punishment aimed at different kinds of medical institutions; promoting the professional law executing level, work efficiency and quality of health inspection personnel simultaneously.
