The Protection and Remedy of Rights Under Emergency State

Under emergency state,governments should have necessary emergency powers,including power to restrict or deprive citizens' legal rights and interests and to meet the need of public interest and order.These powers should be regulated reasonably under rule of law.It is an important object or orientation of Emergency Law to protect citizens' legal rights and interests.Governments should follow some legal principles when they exercise emergency powers.Facing governments' emergency powers,except for some elemental rights which mustn't be restricted,citizens should also enjoy the right to know,to supervise,to ask for emergency salvation,to apply for administrative reconsideration and litigation,to apply for compensation of damages in order to get effective remedy.
