Non-singleness:the legal nature of the shipbuilding contract

The shipbuilding contract might be deemed as sales contract or contract for work in different jurisdictions.After a comparative analysis of the legal nature of the shipbuilding contract in the major maritime jurisdictions,it is pointed out that the intention of the contractual parties shall be taken for the determination of the legal nature of the shipbuilding contract.Without expressed intention,certain elements might be used for the presumption of the true intention.Failure of the presumption,the shipbuilding contract shall be taken as a mixture of the sales contract and the contract for work.
