Strategic Use of PCT National Phase

In PCT procedures, the most challenging decision a PCT applicant must make perhaps is how to enter the national phase strategically, which has an important bearing not only on whether valid and strong patents can be obtained, but also on whether commercial successes can be expected for the patented products. In explaining whether, when and where to enter the national phase under the PCT, the article gives an analysis of the various factors to be considered by enterprises for mapping out their patent strategies, which may include patentability of inventions, market, product life circle, commercial/technological cooperation, cost, return on investment and patent representation. The article emphasizes scientific development concept in the effective use of the relevant strategies concerning PCT national phase.
