Discussion on the application of information-related non-profit civil litigation against the background of big data

Under the background of big data, personal information is universally collected and used in an insecure and unilateral way. The information subject transfers part of his or her information right in exchange for convenience, while the information management party processes information after obtaining the consent of the information subject through information collection portal. Due to various reasons, the traditional private interest litigation cannot realize the effective relief of personal information rights, so public interest litigation is needed. By studying related cases, it is found that there are disputes over the prosecutor′s eligibility and the compensation system. Therefore, it is suggested that relevant laws on personal information protection should define the eligible subject of prosecution and refine the compensation system so as to better protect the personal information right.
